CUSTOM WHEEL GIVEAWAY OFFICIAL RULES
1. ELIGIBILITY: RimTyme Custom Wheel Giveaway is open only to legal residents of the fifty (50) United States (andthe District of Columbia) who are at least eighteen (18) years old at the time of entry. Employees of RimTyme(“Sponsor”), any of its affiliate companies, franchisees, sales representatives, distributors, advertising agencies,promotional suppliers as well as the immediate family (spouse, parents, siblings and children) and householdmembers of each such employee are not eligible. The Giveaway is subject to all applicable federal, state,municipal, and local laws and regulations and is void where prohibited by law. Participation constitutes entrant’sfull and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which arefinal and binding in all matters related to the Giveaway. Winning the prize is contingent upon fulfilling allrequirements set forth herein. Void where prohibited.
2. SPONSOR: RimTyme Custom Wheels and Tires, Plano, TX: 5501 Headquarters Drive, Plano, TX 75024
3. TIMING: The Giveaway begins on October 15, 2023 at 12:00 a.m. Central Time and ends on December 31, 2023at 11:59 p.m. Central Time (the “Promotion Period”). Administrator’s computer is the official time-keeping devicefor the Custom Wheel.
4. HOW TO ENTER: Limit one (1) entry per person. Entries may be submitted on or before 6 p.m. [central time] onDecember 31. Sponsor is not responsible for incomplete, untimely, lost, or misdirected entries. All entries becomethe property of Sponsor in accordance with the terms of submission and entrant grants RimTyme and itsfranchisees an irrevocable, royalty free license will not be returned. Sponsor is not responsible for erroneous,inaccurate or incomplete data provided by any entrant or for any change of mailing address and/or phone numberof entrants.
5. LIMIT ON ENTRIES: Each participant may enter one (1) time during the Promotion Period. Multiple participantsare not permitted to share the same email address. Any attempt by any entrant to obtain more than the statednumber of entries by using multiple/different email addresses, identities, registrations and log ins, or any othermethods will void that entrant’s entries and that entrant may be disqualified. Use of any automated system toparticipate is prohibited and will result in disqualification. The potential winner may be required to show proof ofidentification.
6. PRIZE WINNER: At the conclusion of the giveaway period (ending at 11:59 [central time] on the last day of themonth of December), one (1) winner will be selected from all eligible entries received on rimtyme.com. Potentialwinner will be contacted by phone and/or mail at Sponsor’s discretion. Non-winning entries will not be re-enteredinto future drawings.
7. PRIZE/APPROXIMATE RETAIL VALUE (ARV)/ODDS: Selected winner will receive one (1) a set of cast customwheels that are in stock and not special order, from one of the following three wheel brands: Fuel, Niche andAmerican Racing. (Retail Value ARV: $2000 USD). Odds of winning depend upon number of entries received. Allapplicable federal, state and local taxes are the responsibility of the prize winner.
8. GENERAL CONDITIONS AND PRIZE SUBSTITUTION: Sponsor reserves the right to cancel, suspend and/or modifythe Giveaway, or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrityor proper functioning of the Giveaway, as determined by Sponsor in its sole discretion. Sponsor reserves the rightin its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation ofthe Custom Wheel Giveaway or to be acting in violation of the Official Rules of this or any other promotion or in anunsportsman like or disruptive manner. Any attempt by any person to deliberately undermine the legitimateoperation of the Giveaway may be a violation of criminal and civil law, and, should such an attempt be made,Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’sfailure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If prize notificationor prize delivery is returned as non-deliverable, prize may be forfeited and an alternate winner may be selected. IfSponsor is not able to contact winner within 14 days after the drawing then an alternate winner will be chosen.Except at Sponsor’s discretion, no cash redemptions, substitutes, or transfer of prizes allowed. Subject to allfederal, state and local laws/regulations. Prize will be awarded if claimed properly (i.e. full compliance with OfficialRules). In case of unavailability of any prize, Sponsor reserves the right to substitute a prize of equal or greatervalue. Prize winner grants to Sponsor the right to use his/her name, voice, likeness and/or prize information inadvertising and promotion without further compensation or permission, except where prohibited by law. Byaccepting this prize, the winner agrees that Sponsor will not be held responsible for any loss of property, accidents,injuries, or death that may occur in the receipt, awarding or use or possession of prize. Winner acknowledges thatneither Sponsor nor its agents have made, nor are in any manner responsible or liable for, any warranty,representation or guarantee, expressed or implied, in fact or in law, relative to any prize, including, but not limitedto, its quality, mechanical condition or fitness for a particular purpose. Any and all warranties and/or guaranteeson a prize, if any, are subject to the manufacturers’ terms therefore and the winner agrees to look solely to suchmanufacturer or issuers for any such warranty and/or guarantee. Sponsor is not responsible for any typographicalor other error in printing, offering or announcement of prize. Products/prizes determined by Sponsor in its solediscretion. Prize is non-transferable and no substitution will be made except as provided herein at the Sponsor’ssole discretion. Sponsor reserves the right to substitute the prize for one of equal or greater value if the designatedprize should become unavailable for any reason. Winner is responsible for all taxes and fees associated with prizereceipt and/or use.
9. PUBLICITY: Except where prohibited, participation in the Custom Wheel and Tire Giveaway constitutes winner’sconsent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometownand state or province for promotional purposes in any media, worldwide, without further payment orconsideration.
10. RELEASE: By receipt of any prize, winner agrees to release and hold harmless and any of its affiliate companies,franchisees, sales representatives, distributors, advertising agencies, promotional suppliers (“Released Parties”)and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prizesuppliers, and each of their respective parent companies and each such company’s officers, directors, employeesand agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but notlimited to, personal injury, death, or damage to or loss of property, arising out of participation in the Giveaway orreceipt or use or misuse of any prize.
11. LIMITATIONS OF LIABILITY: The Released Parties are not responsible for: (1) any incorrect or inaccurateinformation, whether caused by entrants, computer or system errors or by any of the equipment or programmingassociated with or utilized in the Giveaway; (2) technical failures of any kind, including, but not limited tomalfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorizedhuman intervention in any part of the entry process or the Giveaway; (4) technical or human error which mayoccur in the administration of the Giveaway or the processing of entries; (5) late, lost, undeliverable, damaged orstolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, inwhole or in part, from entrant’s participation in the Giveaway or receipt or use or misuse of any prize. If for anyreason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed orcorrupted, entrant’s sole remedy is another entry in the Giveaway, if it is possible. If the Giveaway, or any part ofit, is discontinued for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among alleligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more thanthe stated number of prizes will be awarded. In the event that production, technical, seeding, programming or anyother reasons cause more than the stated number of prizes as set forth in these Official Rules to be availableand/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing amongall legitimate, un-awarded, eligible prize claims.
