RIMTYME WHEEL AND TIRE GIVE AWAY OFFICIAL RULES

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. ELIGIBILITY: RimTyme Custom Wheel and Tire Giveaway is open only to legal residents of the fifty (50) United States (and the District ofColumbia) who are at least eighteen (18) years old at the time of entry. Employees of RimTyme (“Sponsor”), any of its affiliate companies, franchisees,sales representatives, distributors, advertising agencies, promotional suppliers as well as the immediate family (spouse, parents, siblings andchildren) and household members of each such employee are not eligible. The Giveaway is subject to all applicable federal, state, municipal,and local laws and regulations and is void where prohibited by law. Participation constitutes entrant’s full and unconditional agreement to theseOfficial Rules and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Giveaway. Winning the prizeis contingent upon fulfilling all requirements set forth herein. Void where prohibited.
2. SPONSOR: Purple22s, LLC dba RimTyme 3030 N. Rocky Point Dr W, Ste 262 Tampa, FL 33607. Administered by Purple22s, LLC dba RimTyme.
3. TIMING: The Giveaway begins on February 18, 2022 at 12 a.m. Central Time and ends on September 21, 2022 at 11:59 p.m. Central Time(the “Promotion Period”). Administrator’s computer is the official time-keeping device for the Custom Wheel and Tire Giveaway. All prize winners will be determined no later than October 1, 2022. NASCAR SPENCER BOYD RIMTYME SPONSORSHIP, FEBRUARY 18 - SEPTEMBER 21 ENTER TO WIN A SET OF CUSTOM WHEELS & TIRES.*
4. HOW TO ENTER: Limit one (1) entry per person. Entries may be submitted on or before 11:59 p.m. [central time] on September 21. Sponsor is not responsible for incomplete, untimely, lost, or misdirected entries. All entries become the property of Sponsor in accordance with the terms of submission and entrant grants RimTyme and its franchisees an irrevocable, royalty free license will not be returned. Sponsor is not responsible for erroneous, inaccurate or incomplete data provided by any entrant or for any change of mailing address and/or phone number of entrants.
5. LIMIT ON ENTRIES: Each participant may enter one (1) time during the Promotion Period. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different e-mail addresses, identities, registrations and log ins, or any other methods will void that entrant’s entries and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. The potential winner may be required to show proof of identification.
6. PRIZE WINNER: All entries winners will be posted at the store. At the conclusion of the giveaway period (ending at 11:59 p.m. [central time] on the day of the drawing, each drawing will have one (1) winner will be selected from all eligible entries received at each participating location. Entrant need not be present to win. Potential winner will be contacted by phone and/or mail at Sponsor’s discretion. Non-winning entries will not beinto future drawings.
7. PRIZE/APPROXIMATE RETAIL VALUE (ARV)/ODDS: Selected winner will receive one (1) set of custom wheels and tires that the store has in stock. (ARV: $2500 USD). Odds of winning depend upon number of entries received. All applicable federal, state and local taxes are the responsibility of the prize winner.
8. GENERAL CONDITIONS AND PRIZE SUBSTITUTION: Sponsor reserves the right to cancel, suspend and/or modify the Giveaway, or any part of it,if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the Giveaway, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or theoperation of the Custom Wheel and Tire Giveaway or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsman like or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If prize notification or prize delivery is returned as non-deliverable, prize may be forfeited and an alternate winner may be selected. If Sponsor is not able to contact winner within 14 days after the drawing then an alternate winner will be chosen. Except at Sponsor’s discretion, no cash redemptions, substitutes, or transfer of prizes allowed. Subject to all federal, state and local laws/regulations. Prize will be awarded if claimed properly (i.e. full compliance with Official Rules). In case of unavailability of any prize, Sponsor reserves the right to substitute a prize of equal or greater value. Prize winner grants to Sponsor the right to use his/her name, voice, likeness and/or prize information in advertising and promotion without further compensation or permission, except where prohibited by law. By accepting thisprize the winner agrees that Sponsor will not be held responsible for any loss of property, accidents, injuries, or death that may occur in the receipt, awarding or use or possession of prize. Winner acknowledgesthat neither Sponsor nor its agents have made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, expressedor implied, in fact or in law, relative to any prize, including, but not limited to, its quality, mechanical condition or fitness for a particular purpose.Any and all warranties and/or guarantees on a prize, if any, are subject to the manufacturers’ terms therefore and the winner agrees to look solely to such manufacturer or issuers for any such warranty and/ or guarantee. Sponsor is not responsible for any typographical or other error in printing, offering or announcement of prize. Products/prizes determined by Sponsor in its sole discretion. Prize is non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute the prize for one of equal or greater valueif the designated prize should become unavailable for any reason. Winner is responsible for all taxes and fees associated with prize receipt and/or use.
9. PUBLICITY: Except where prohibited, participation in the Custom Wheel and Tire Giveaway constitutes winner’s consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state or province for promotional purposes in any media, worldwide, without further payment or consideration.
10. RELEASE: By receipt of any prize, winner agrees to release and hold harmless and any of its affiliate companies, franchisees, sales representatives, distributors, advertising agencies, promotional suppliers (“Released Parties”) and their respective subsidiaries, affiliates, suppliers, distributors,advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors,employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personalinjury, death, or damage to or loss of property, arising out of participation in the Giveaway or receipt or use or misuse of any prize.
11. LIMITATIONS OF LIABILITY: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants,computer or system errors or by any of the equipment or programming associated with or utilized in the Giveaway; (2) technical failures of any kind,including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Giveaway; (4) technical or human error which may occur in the administration of the Giveaway or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Giveaway or receipt or use or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Giveaway, if it is possible. If the Giveaway, or any part of it, is discontinued for any reason, Sponsor, at its discretion, mayelect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.
